Overview

Welcome to Dusk Oak. The terms "we", "us" and "our" refer to Dusk Oak, a trading name of Chase Loot Ltd, a company registered in England and Wales. We operate this website and store, including all related content, features, tools, products and services (the "Services"), to provide you with a curated home and lifestyle shopping experience. Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully. By visiting or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Nothing in these Terms affects your statutory rights as a consumer under UK law, including under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

1. Access and Account

By using the Services you confirm that you are at least 18 years of age, or are using the Services with the involvement of a parent or guardian. When you provide information such as your email, billing, payment or delivery details, you confirm that it is accurate, current and complete. You are responsible for keeping your account details secure and for all activity on your account. Accounts may not be sold or transferred.

2. Our Products

We make every effort to display our products accurately. However, colours and finishes may appear differently depending on your screen and device settings, and natural materials such as wood, ceramic and stone can vary slightly from piece to piece. Product descriptions may be updated at any time, and we may discontinue products or limit quantities at our discretion. None of this affects your statutory right to receive goods that match their description and are of satisfactory quality.

3. Orders

When you place an order, you are making an offer to purchase. Your order is accepted when we send you a dispatch confirmation, at which point a contract is formed between you and Dusk Oak. We may decline or cancel an order where, for example, a product is unavailable, we identify a pricing or description error, or we suspect fraud. If we do, we will notify you using the contact details you provided and refund any payment taken.

If you wish to cancel or amend an order before dispatch, contact us as soon as possible at info@duskoak.com and we will do our best to help. Your rights to cancel after delivery are set out in our Refund Policy and in section 5 below.

Purchases are for personal and household use and not for commercial resale.

4. Prices and Billing

Prices, discounts and promotions may change without notice. The price charged is the price displayed at the time you place your order, as confirmed in your order confirmation email. All prices shown include UK VAT where applicable. Delivery charges, if any, are shown at checkout before you pay.

You agree to provide accurate and current payment information and confirm that you are authorised to use the payment method provided. Where a promotion has its own terms, those terms apply to the promotion.

5. Delivery and Your Right to Cancel

Delivery timeframes are set out in our Shipping Policy. Delivery estimates are given in good faith. Where a delay occurs, we will keep you informed and you may cancel for a full refund if we are unable to deliver within a reasonable period.

As a UK consumer buying online, you have the right under the Consumer Contracts Regulations 2013 to cancel your order for any reason within 14 days of receiving your goods, and a further 14 days to return them, subject to the process set out in our Refund Policy. This does not affect your separate statutory rights where goods are faulty, not as described, or not of satisfactory quality.

Risk in the goods passes to you on delivery. Ownership passes on the later of delivery or receipt of full payment.

6. Intellectual Property

All content on the Services, including our name, branding, text, images, graphics, product descriptions, photography and design, is owned by or licensed to Dusk Oak and is protected by copyright, trade mark and other intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify or republish any material from the Services without our prior written consent. Shopify's name and branding are trademarks of Shopify. All other marks are the property of their respective owners.

7. Third-Party Tools and Links

The Services may include optional third-party tools or links to third-party websites that we do not control. These are provided as a convenience and without endorsement. We are not responsible for the content, accuracy or practices of third parties, and any use of third-party tools or websites is at your own discretion. Please review third-party terms and policies before engaging with them.

8. Relationship with Shopify

Our store is hosted by Shopify, but all purchases you make are made directly with Dusk Oak. Shopify is not a party to, or responsible for, any transaction between you and us.

9. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, Shopify also processes certain information about your use of the Services in order to provide and improve them. Please review our Privacy Policy for full details.

10. Reviews and Feedback

If you submit reviews, suggestions or other content ("Feedback"), you grant us a worldwide, royalty-free licence to use, reproduce and display that Feedback in connection with the Services, including for promotional purposes. You confirm that your Feedback is your own, is accurate and honest, discloses any incentive you received, and does not infringe anyone else's rights or contain unlawful, offensive or malicious material. We may moderate or remove Feedback at our discretion.

11. Errors and Omissions

Occasionally, information on the Services may contain typographical errors or inaccuracies relating to descriptions, pricing, promotions or availability. We reserve the right to correct errors and update information at any time, and to cancel orders affected by an obvious error, in which case you will receive a full refund.

12. Acceptable Use

You may use the Services for lawful purposes only. You must not use the Services to break the law, infringe intellectual property rights, harass or harm others, transmit false or misleading information, send spam, impersonate any person, upload viruses or malicious code, scrape or harvest data, or interfere with the security or operation of the Services. We may suspend or terminate access for breach of these Terms.

13. Our Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under UK law, and nothing in these Terms affects your statutory rights as a consumer.

Subject to the above, we are not liable for losses that were not foreseeable to you and us when the contract was formed, losses not caused by our breach, or business losses, and our total liability in connection with any order is limited to the price you paid for that order.

14. Termination

We may suspend or end your access to the Services if you breach these Terms. Any sections which by their nature should survive termination, including those relating to intellectual property, liability and governing law, will continue to apply.

15. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. A failure by us to enforce any right is not a waiver of that right. You may not transfer your rights under these Terms without our consent. These Terms, together with the policies referenced in them, form the entire agreement between you and us regarding the Services.

16. Governing Law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts. This does not affect your right to use alternative dispute resolution.

17. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on this page with the date of the last update shown above. Material changes will apply from the date stated in the updated Terms.
